Abu Dhabi: Residents facing environmental fines in Abu Dhabi now have an opportunity to reduce their penalties under certain conditions, thanks to a new regulation issued by the Environment Agency – Abu Dhabi (EAD). The regulation outlines reconciliation and appeal procedures for environmental administrative violations, fostering transparency and encouraging compliance.

Developed under the provisions of law, which governs EAD’s operations, the regulation allows violators to settle their fines by paying 75 per cent of the total administrative penalty, provided they commit to rectifying their actions. This initiative covers violations listed under EAD's Board of Directors Decision and specifies a clear framework for reconciliation, settlement, and appeal processes.

Key highlights of the regulation:

  • Reconciliation terms: Settlement is not permitted for repeated violations unless one calendar year has passed since the prior infraction. Additionally, reconciliation is prohibited for violations deemed to have a significant environmental impact as determined by EAD.

  • Payment deadlines: If reconciliation is not granted or is rejected, violators must pay the full fine within a specified period. They are also required to restore any environmental damage caused by the violation within the timeline set by EAD. If this obligation is not met, EAD will undertake restoration efforts at the violator’s expense.

  • Appeal rights: Violators may appeal their penalties within 60 days of notification, providing reasons and supporting evidence for their case. Rejected appeals will result in mandatory fine payment, and appeal decisions are considered final.

Dr. Shaikha Salem Al Dhaheri, Secretary General of EAD, stated: “The introduction of this regulation strengthens Abu Dhabi’s environmental legislative framework, ensuring effective enforcement of administrative fines while addressing the negative environmental impacts of development, industry, tourism, and other activities. Our goal is to protect and sustain the emirate’s environment for future generations.”

EAD plans to implement the new procedures across Abu Dhabi in collaboration with its strategic partners, ensuring systematic and organised enforcement of environmental compliance.
