12-month notice should be provided for eviction in these cases – Dubai Land Department

Landlords need to have proof through a technical report for such cases

Dubai: Dubai Land Department (DLD) has issued a reminder to raise awareness among tenants – if your landlord requires you to vacate the premises due to extensive maintenance work or demolition, he or she is required to inform you a year in advance.

As per the information shared by Dubai Land Department on its official social media channels, landlords can request for a tenant to vacate a property, if the maintenance or restoration work is so extensive that it would make it impossible to conduct it while the tenant still lives in the premises. Similarly, in case the building needs to be demolished, the landlord can once again ask tenants to vacate their homes. However, in both cases, they are required to provide a technical report from the relevant authorities like Dubai Municipality or a government department, and also inform the tenants through a notice issued by a Notary Public.

In both cases, the tenant should be given a 12-month notice.

Eviction due to restoration or comprehensive maintenance

As per DLD, the landlord can request for eviction if the property is in a condition that requires restoration or comprehensive maintenance that cannot be carried out in the presence of the tenant in the property, provided that the condition of the property is verified by a technical report issued by or attested to by the Dubai Municipality.

Conditions that need to be fulfilled for such an eviction claim:

  • Proof of the condition of the property verified by a technical report issued by or attested to by Dubai Municipality.
  • The landlord will give notice to the tenant through a Notary Public or registered post of the necessity of eviction along with mentioning the reason.
  • The landlord must give the tenant a period of 12 months from the date of delivery of such notice.

Eviction due to demolition

These are situations where the owner of the property wishes to demolish the property to reconstruct it, or to add any new constructions that will prevent the tenant from using the property, provided that the required permits are obtained from the competent entities.

Conditions that need to be fulfilled for such an eviction claim:

  • Proof of obtaining the necessary permits from the government.
  • The landlord will give notice to the tenant through a Notary Public or registered post of the necessity of eviction along with mentioning the reason.
  • The landlord must give the tenant a period of 12 months from the date of delivery of such notice.

What is a notary public?

The term refers to offices that are accredited, authorised, or licenced by the Judicial Department to attest and notarise customary documents and to practise legal functions, as specified under the law.
