I have rented an office in Dubai and my one-year agreement started from July 2012. I have paid all the instalments to the Real Estate Office in post-dated cheques. The contract will expire on June 2013. Due to some financial problem I’m facing in my business my next rental cheque will definitely bounce. I want to cancel the contract. And I have sent a letter to the Real Estate Office in this regard. The Real Estate Office has rejected for the reason that the Agreement is still valid. And they have refused to return the remaining instalments. In the Tenancy Agreement there is a clause that gives the right for both parties, landlord and tenant, to break the contract after four months on the condition that either party will give a one-month warning notice and pay one month rent as compensation. My question is, is it possible to break this contract with the reference to this Clause mentioned? Will the Municipality Rental Committee accept this Clause? Please clarify as the Real Estate Office told me that I have to provide a new tenant to replace me, and only then will the tenancy contract be cancelled.

According to the clause mentioned in the agreement, the questioner has the right to break the contract after he provides a Real Estate Office with a one-month notice and pay one month rent compensation as agreed. Then you have the right to ask for the refund of the instalments and you are not obliged to find a new tenant to replace you and therefore, in case there is no amicable settlement with the Real Estate Office, you have the right to file a complaint to the Dubai Municipality Rental Committee.
