Abu Dhabi court dismisses case, saying plaintiff failed to prove agreement

The Abu Dhabi Civil Family and Administrative Court has dismissed a lawsuit filed by a man who accused another of unlawfully retaining Dh478,084, which he claimed was handed over for investment in cryptocurrency. The court ruled that the plaintiff failed to provide evidence proving the existence of an investment agreement or the reason behind the bank transfers, Emarat Al Youm reported.
The plaintiff argued that he transferred the funds in several instalments as part of an investment arrangement and demanded repayment with 12 per cent annual interest from the date of filing until full settlement. The defendant denied the allegations and submitted documents requesting dismissal.
In its judgment, the court stated that the transfers merely showed money being sent from one person to another, and it is the claimant’s responsibility to prove the legal basis of the transaction. It noted that the default legal presumption is the absence of liability, and any claim of debt requires supporting evidence.
The court added that it was not required to instruct the plaintiff to submit further proof, emphasising that rulings must be based on documents presented. As the plaintiff failed to substantiate his claim, the case was dismissed, and he was ordered to pay court fees and legal costs.
