Husband failed to prove Dh115,000 from wife was for family support, Abu Dhabi court rules

Abu Dhabi: A man has been ordered to pay his wife Dh115,000 after a UAE court ruled the amount was an unpaid loan—not a family expense, as the husband claimed.

The Abu Dhabi Family, Civil and Administrative Claims Court found that while the husband admitted receiving the money, he could not prove it was for shared family support or to settle his wife’s debts.

Appeal dismissed, original verdict upheld

The wife said she transferred the amount as a loan and cash advance. After repeated delays in repayment, she filed a lawsuit. The Court of First Instance ruled in her favour. The husband appealed, but the Court of Appeal upheld the decision.

To support her claim, the wife took a supplementary oath in court. The judge noted the husband's arguments were “unsubstantiated” and unsupported by evidence.

Legal costs also to be paid by husband

Citing Article 133 of the Civil Procedure Law, the court ordered the husband to repay Dh115,000 and cover all court fees and legal expenses. All other claims were dismissed.
