Cassation Court to review businesswoman's appeal

Three people were acquitted of defrauding her

Dubai: Dubai Cassation Court will soon look into an appeal lodged by a Lebanese businesswoman against an ex-minister and two managers, who were acquitted of defrauding her, Gulf News learnt on Monday.

Advocates from Essam Al Tamimi Group, who represent the businesswoman in civil rights, yesterday appealed the Dubai Appeals Court's judgment in which Emirati former state minister, K.B., American general manager S.A., and Indian finance manager, P.M., were acquitted of swindling and misleading the businesswoman, M.J., to waive her stake in an information technology firm.

Court sources told Gulf News on Monday that the claimants in civil right appealed the acquittal verdict before the Cassation Court which will schedule a hearing to review the appeal soon.

Gulf News also learnt that Dubai Public Prosecution (DPP) is expected to appeal the judgment today, it being the last day to lodge the petition.

Last month, the Appeals Court acquitted K.B., S.A. and P.M. of swindling and misleading M.J.

"K.B., S.A. and P.M. are innocent of the charge of swindling. The court rejected DPP's appeal.

"The court also dismissed M.J.'s appeal in civil rights, regarding the swindling charge, because it fell beyond the criminal court's jurisdiction.

"The claimant in civil right has to pay court fees and Dh1,000 lawyers' fees as well," said Presiding Judge Adnan Al Farra.

In July, the Dubai Court of Cassation overturned the acquittal of the three defendants and ordered a new panel of appeal judges to hold a retrial concerning the swindling charge.

K.B., S.A. and P.M. had denied the charge of swindling and defrauding M.J. by coercing her into waiving her late brother's stake in the company.
