Job contracts for nationals standardised

Matar Humaid Al Tayer, Minister of Labour and Social Affairs, issued Ministerial Decision No. 955 of 2002 concerning a standardised employment contract for UAE nationals employed by the private sector.

The decision, which took effect from December 25, made it obligatory for private employers to conclude standardised contracts with UAE nationals and follow certain procedures for processing and registering their contracts.

The contract is available online on the website of the National Human Resource Development and Employment Authority (Tanmia) at www.tanmia.ae.

According to Article 2 of the decision, an employer or his representative must log onto the Tanmia website, enter the details of the contract and get it printed.

Tanmia's programme will review the details and refer to any information that contravenes the provisions of the Labour Law. For instance, if a UAE worker is under 18 years of age, a probational period exceeds six months, the annual leave is less than 30 days, or the pension is less than Dh1,000 or more than Dh50,000.

The employer or his representative will correct any mistakes and the programme will check the contract again.

Finally, the programme will register the details entered and produce a contract number. The contract will then be printed in three copies along with a list of the documents required to get the contract registered with the General Pension and Social Insurance Authority.

If the employer has no account with the General Pension and Social Insurance Authority, the programme will produce the requirements for opening an account.

A copy of the signature authorisation duly attested by the Ministry of Labour and Social Affairs must be enclosed.

The employer or his representative will sign the contract as a first party, while the worker will sign as the second party.

The employer will then submit the contract and other required documents to the General Pension and Social Insurance Authority for registration. The transaction must be processed within no more than 30 days.

The authority's official in charge will sign and stamp the contract. It will be scanned and saved in the authority's database.

Copies will be automatically sent to the Ministry of Labour and Social Affairs and Tanmia.
