Passengers employed by company are excluded unless covered by additional policy
Question: My father died four months ago in an accident while on his way to work in the company bus, which was insured. We requested compensation from the insurance company for my father's death, but the claim was rejected on the grounds that my father's employer (the insured) did not include employees in the insurance policy concluded with the insurance company. Do I have the right to claim compensation from the insurance company in this case?
Answer: Chapter Two of the Unified Motor Vehicle Insurance Policy Against Third Party Liability, concerning the obligations of the insurance company, excludes (from such payment) any passengers employed by the insured if they are injured during and because of work. In the case of any accident resulting from the use of a motor vehicle, the insurance company shall compensate the injured third party – within the scope of its limits – for all amounts the insured or the vehicle driver is obligated to pay as compensation for:
First: Death or bodily injury caused to any person, including the passengers, except for the insured and the driver of the motor vehicle that has caused the accident, and the passengers employed by the insured, if they are injured during and because of work.
Moreover, Chapter Four of the same Unified Policy states that compensation will be paid only if the insured company has made an additional policy for its employees.
This insurance does not cover the third-party liability arising or emerging from accidents that are caused by the insured motor vehicle in the following cases:
Accidents involving the Insured, the motor vehicle driver, or persons employed by the Insured if they are injured during and because of work, unless they have obtained additional coverage under a rider or another policy.
This means you have to check the insurance policy concluded between your father’s company (the insured) and the insurance company. If the insured company made an additional coverage for its employees, then you have the right to take compensation. Otherwise, you would not be eligible for such compensation. In any case, such matter will be decided by the court after checking all the documents related to the situation.
