The attempt to reopen the case was found to lack legal standing and was formally dismissed
Abu Dhabi: The Court of Cassation in Abu Dhabi has dismissed a final petition to reopen a long-settled fraud case, ruling that such appeals are impermissible once a cassation verdict has been issued.
The case involved a man previously convicted of fraudulently obtaining funds from another individual under the false pretext of offering investment opportunities.
The plaintiff had filed a civil lawsuit seeking Dh373,000 in restitution and Dh190,000 in compensation. The court ultimately ordered the defendant to pay Dh423,000, including Dh50,000 in damages.
The defendant contested the ruling through the appeals process; however, the Court of Appeal upheld the original verdict and dismissed his challenge.
He then took the case to the Court of Cassation, which also rejected his appeal. In a final attempt to revive the case, the defendant submitted a petition for reconsideration.
The court, however, ruled that such petitions are not legally valid once the Court of Cassation has issued a final ruling or deemed a previous appeal inadmissible. Since the case had not been re-examined on its merits at the cassation level, the attempt to reopen it was found to lack legal standing and was formally dismissed.
