Dubai: A worker has been cleared of assaulting a sewage tanker driver and causing his death after the victim suffered a cardiac seizure.
The Pakistani sewage tanker driver, who was a heart patient, took his assistant to a recycling station to dispose of the waste in March.
The driver then asked his assistant to unload the waste at the station and left. After 20 minutes, the driver, who was breathing heavily, called his assistant and asked for help.
The assistant located the driver and found him to be suffering from a cardiac seizure and he called an ambulance.
The driver succumbed to a cardiac arrest after his arrival at the hospital where the efforts to revive him failed.
A police corporal, who arrived at the hospital as part of routine procedures, discovered that the deceased had bruises under his eyes.
Preliminary investigation revealed that during his 20-minute disappearance near the recycling station, the driver had a heated argument with a 30-year-old Pakistani worker that led to a fight.
Dubai Police’s forensic examiner confirmed that the deceased suffered a heart seizure that was triggered by a sudden mental and emotional upheaval besides physical tension.
The Dubai Court of First Instance acquitted the 30-year-old Pakistani worker of assaulting the victim and being responsible for his death citing lack of corroborated evidence.
The suspect’s judgement was issued in absentia after he failed to attend his trial.
The police corporal told prosecutors that when he went to the hospital, he found bruises under the victim’s both eyes.
“When I asked the claimant [Pakistani assistant], he alleged that the victim left him and went somewhere … 20 minutes later he received a call from the driver who told him that he needed his help. The assistant claimed that when he rushed to help the driver, he found him breathing heavily and leaning on a chair. Then witnesses claimed that a fight happened between the deceased and the suspect. Upon questioning the latter, he admitted that he had a heated argument with the victim that developed into a fight … however he claimed that it was a minor fight,” the corporal testified.
