Dubai: A man accused of locking a woman naked outside his flat shortly after they had sex denied the charge in court on Monday .

In November, the Dubai Court of First Instance sentenced the 40-year-old Emirati employee to three years in jail for beating the Uzbek woman, raping her and locking her naked outside his flat in January 2017.

The Emirati defendant was sentenced in absentia after he failed to attend his trial.

However, he was later apprehended and requested a retrial, during which his charges were modified from rape to consensual sex.

According to the modified charge-sheet, prosecutors also charged him with outraging the woman’s modesty and molestation.

“Yes, I had consensual sex with her, but did not leave her naked outside my flat,” the Emirati defendant argued before presiding judge Urfan Omar in courtroom three.

According to records, the naked woman rushed to an adjacent flat occupied by Russian women, who gave her clothes to cover up. She then reported the matter to the police around 7pm.

The defendant was apprehended four days after the victim’s complaint. He was hiding in a rooftop room in Al Nahda.

He contended in court earlier that the door was open and she went out on her own.

The woman testified that she knew the defendant since he had bailed her out in a criminal case/

“I visited him at his residence several times to discuss my criminal case. I never slept over at his flat and we never kissed or had sex before. I stay with my sister in Sharjah. That day, I went to his place to discuss my case and we sat in the balcony where he had been drinking liquor. He had a heated argument with his children and sent them away, then he yelled at me, grabbed my phone and tossed it out the window. When I tried to leave the flat, he pulled me by my hair and dragged me into the bedroom. He raped and abused me for nearly two hours. Then he dragged me again by my hair and pushed me out of the flat naked,” she said.

A police lieutenant said the CCTV footage showed the woman arriving at the defendant’s flat and chatting with his children at the door around 4.30pm.

“The woman was also seen undressed outside the flat. During questioning, the defendant said he had been having consensual sex with the Uzbek for a year,” the lieutenant said.

A ruling will be heard on April 30.
