Islamabad: A single bench of the Lahore High Court (LHC) is taking up on Monday a petition against former interior minister and veteran politician Chaudhry Nisar Ali Khan for not taking oath of office despite winning from the Punjab Assembly’s constituency PP-10 (Rawalpindi) in July 2018 general elections.
Lawmaker-elect Khan’s continued failure to take oath in the Punjab Assembly has been challenged by petitioner Mian Asif Mahmood through Advocate Nadeem Sarwar who has cited Chaudhry Nisar Ali Khan and Election Commission of Pakistan (ECP) as respondents in his plea.
According to the petitioner, by not taking oath of office, Khan was not only betraying voters of his constituency who reposed trust in him but he was also violating the Constitution’s Articles 2-A, 17 and 25.
The petitioner has requested the court to direct both the Election Commission of Pakistan to de-notify Khan for his failure to take oath and the government to amend the relevant laws and introduce a time frame for lawmakers-elect to take their oath.
Khan was elected as member of provincial assembly (MPA) from PP-10 Rawalpindi in the general elections of 2018, however he has not taken oath so far.
Pakistan Tehreek-e-Insaf (PTI) too tabled a resolution in Punjab Assembly demanding to cancel membership of former interior minister.
