New Delhi: Terming it as a victory of Islam and Muslim women in India, the All India Muslim Women Personal Law Board (AIMWPLB) and All India Shia Personal Law Board (AISPLB) on Tuesday welcomed the Supreme Court (SC) judgement on instant triple talaq.

“The Supreme Court decision is historic, it is the victory of women in the country. But more than that, it is the victory of Islam. We hope that triple talaq will be banned once and for all in times to come. It causes immense hardships to Muslim women even though there is no provision of triple talaq in Islam,” AIMWPLB President Shaista Amber told Gulf News.

AISPLB spokesperson Maulana Yasoob Abbas said the verdict will help end harassment of Muslim women in the country.

“There was no arrangement of triple talaq in the times of Prophet Mohammad [PBUH]. We want a strong legislation against triple talaq in Parliament,” he said.

However, the All India Muslim Personal Law Board (AIMPLB) said Personal Laws cannot be tested by the courts on the grounds they are a violation of fundamental rights.

“We are aware that many Muslims believe that triple talaq in one sitting has a basis in religious beliefs and practices. The Supreme Court’s view cannot be misused by the government to try to interfere with Personal Laws through legislation,” AIMPLB President Mohammad Rabey Hasan Nadwi told Gulf News.

He said the verdict will be examined by the Board.

“While we accept the judgment, we will examine the issue of the implementation and will work to resolve the same. It is our responsibility to implement it and the best way is to ensure that is following its guidelines. Islamic Sharia gives equal status to men and women. The truth is that talaq was kept to protect women from danger,” he added.

AIMPLB will chalk out its future course of action with regard to the judgement in its working committee meeting next month.

“The working committee meeting in Bhopal on September 10 will take a decision on the future course of action on today’s Supreme Court verdict after studying it in detail,” board member Zafaryab Jilani told Gulf News.
