Dubai: A beauty salon worker won his appeal on Sunday after a court cleared him of kissing a saleswoman when she had her eyes closed while having a facial.

The Dubai Appeal Court overturned the 35-year-old Egyptian’s worker’s three-month imprisonment and acquitted him of kissing the 23-year-old Romanian saleswoman against her will.

Citing lack of substantiated evidence, presiding judge Eisa Mohammad Al Sharif cleared the suspect after he refuted the accusations and denied kissing the Romanian while her face was covered with cream.

According to the appellate ruling, the court also cancelled the suspect’s deportation order.

The saleswoman alleged that she visited the salon in the building where she lives in Rashidiya in June 2014.

“I wanted to go for a facial… I went to the salon at 1.30pm, but the manager asked me to come back in an hour. I returned to the salon later where the suspect welcomed me and took me into a treatment room. He cleaned my face and then covered it with cream. My eyes were closed when I suddenly felt him kissing my lips… I jumped out of my seat and immediately called the police,” claimed the saleswoman.

Records said the salon’s CCTV footage showed the woman rushing out of the room and arguing with the worker. However, the footage did not reveal what happened inside the room as the shutters were down.

When he defended himself before the Appeal Court, the Egyptian rejected the woman’s claims which he described as fabricated and unfounded.

However, Sunday’s ruling remains subject to appeal before the Cassation Court within 30 days.
