Dubai: A worker has been jailed for three months for raping his friend in his car although she pardoned him and waived her complaint against him.

The 28-year-old Kenyan worker, W.M., had dinner and liquor with his 24-year-old countrywoman friend before he took her in his car, grabbed her by the neck, pinned her down and raped her in December.

The woman reported the matter to the police immediately after she discovered that she was bleeding following the brutal rape.

The Dubai Court of First Instance convicted W.M. of using physical violence while he had sex with the woman, who later dropped her charges against the defendant.

The suspect pleaded not guilty.

According to the primary ruling, W.M. will be deported after serving his jail term.

The presiding judge handed the defendant a lenient punishment after he handed the court a written waiver that he obtained from the woman.

The 24-year-old woman said the incident happened after she met her friends, including W.M., over dinner at a common friend’s house in Satwa.

“Two friends visited me at my residence at 5pm and we spent some time together until 9pm. During that time, W.M. also joined us and we had dinner. Around 10.30pm we decided to go to a common friend’s place to drink alcohol … we stayed at the friend’s place drinking until 12.30am. I asked my countryman friend, S.K., to drop me home … W.M. asked him to drive him home as well because he lived close to my house. I was in the back seat beside W.M. when he started touching me and said he wanted to have sex with me. I asked him to stop. When S.K. reached my residence, he parked at the side and W.M. jumped on me and had sex with me … I couldn’t stop him as he was stronger. He undressed me while S.K. assisted him. He went out of the car when he finished and went to his home. After I realised that I had bled since he had abnormal sex with me, I complained to the police,” she said.

Prosecutors dropped the charge of rape against S.K. due to lack of evidence.

A police officer testified that the woman reported to the police that the two men had raped her.

“She walked into the police station at 1am and claimed that she had been raped. She alleged that after the two men raped her, she tried to communicate with them … but when they did not answer her, she called up Dubai Police’s operations room. She alleged that she got scared and confused because she did not know what to do,” he claimed.

The primary ruling remains subject to appeal within 13 days.
