Dubai: A man lost his appeal and will spend three months in jail for sending email videos of pornographic content to a friend’s 13-year-old daughter and molesting her during home visits.

An Indian mother was checking out on her daughter’s email when she realised that she had received a number of emails containing porn clips in August 2017.

When the mother confronted her daughter, the victim told her that the 27-year-old Indian family friend had been constantly touching her indecently during visits and had emailed her indecent clips.

In February, the Dubai Court of First Instance jailed the Indian defendant for three months for molesting the teenager and sending her porn clips to her email account in an attempt to have sex with her.

The accused appealed his primary judgement and asked the Appeal Court to acquit him.

When he appeared before the appellate court, the defendant pleaded not guilty and denied sending any emails to the girl.

Presiding judge Eisa Al Sharif rejected his appeal and upheld his three-month imprisonment.

The accused will be deported after serving his jail term.

The defendant misused the internet and emailed pornographic videos in an attempt to stoke the girl’s desires to engage with him sexually.

The girl testified that the accused had constantly groped her and sexually abused her during his visits to their house.

“Every time he came to visit my family, he would molest me and touch me indecently. He started doing so since I was 11. He emailed me indecent clips. I was scared to inform my parents because he constantly threatened me and told me that my mother would beat me and send me to India,” she said.

The mother testified that she saw the indecent emails in her daughter’s account while she was checking it out.

“My daughter divulged to me that the accused constantly molested her … she was always angry and nervous whenever he visited us,” she said.

A policeman, who questioned the defendant, said: “The man claimed that he was involved in a love affair with the teenager. He also claimed that he constantly hugged and kissed her whenever he visited them during holidays. The defendant also claimed that the mother once kicked him out of the flat when she found him kissing her daughter on her lips.”

The appellate ruling remains subject to appeal before the Cassation Court.
