Dubai: A man was jailed for three months for punching his roommate, fracturing his jaw and breaking two teeth after asking him to reduce the TV’s volume while watching cricket at 6.30am.

The 42-year-old Indian man, M.A., was enraged when his countryman driver, M.B., asked him to reduce the sound while watching cricket.

The Dubai Court of First Instance convicted M.A. of assaulting M.B. and wilfully causing him a five per cent permanent disability.

The accused had admitted that he assaulted the victim in self-defence and contended that he did not intend to cause him any disability.

“M.A. was watching the cricket game and when I asked him to reduce the volume, he got angry. He punched me when I tried to leave the room. I tried to leave the room again, but the defendant kicked me and broke my jaw. Immediately I called the police and informed them what happened,” testified the driver.

An Indian witness (who shares the same room) testified that he was asleep when he woke up because of the noise of the two men fighting.

“The two were shouting when I woke up. I spotted M.A. when he punched M. B. I had not slept for two consecutive days when I asked the defendant to lower the volume and stop shouting … he yelled back and asked me to sleep outside. I moved outside because M.A. constantly made trouble. The loud voice and shouting continued … when I went back to the room to ask them to reduce the noise, I saw the suspect kicking M.B. The latter bled profusely from his mouth. Police came after 15 minutes,” said the witness.

Prosecution records cited the defendant admitting that he pushed M.B.

The primary ruling remains subject to appeal within 13 days.
