Dubai: A father has been cleared of kidnapping a man and confining him in a villa under construction to coerce him to confess to the alleged rape of his teenage daughter.

Citing lack of corroborated evidence, the Dubai Court of First Instance acquitted the retired Emirati, M.H., and a 34-year-old Pakistani worker, A.M., of forcing the jobless man, from Comoros Island, out of his car and confining him in the villa to force him to admit that he had raped M.H.’s 13-year-old girl.

Court records show that the jobless man was recently acquitted of raping the girl.

Prosecutors accused the father, M.H., and A.M. with kidnapping 22-year-old B.S. and confining him to obtain his confession under duress. M.H. was solely accused of consuming alcohol.

The duo pleaded not guilty and denied the kidnap charge.

“I am not mistaken … but yes I consumed alcohol,” the father told the court.

According to the primary ruling, the father was fined Dh2,000 for drinking.

B.S. alleged to prosecutors that the daughter phoned him and asked to meet him near a park in Al Ghusais.

“I went there by car and she stood beside my vehicle and we chatted for a while. Suddenly her father, brother and A.M. opened the doors and pulled me out. They beat me with a stick … they forced me into another car that her mother drove. They forced me into the villa and kept me inside a room. They beat me again and threatened me with a knife and a gun. They forced me to confess that I had had sex with their daughter,” B.S. claimed to prosecutors.

The girl’s mother claimed in her prosecution statement that her daughter revealed to her that she had had sex with B.S. in March 2014.

“I informed my husband [M.H.], who asked our girl to arrange a meeting with B.S. As soon as he arrived, they pulled him out of his car and I drove my husband’s vehicle to the villa. My son, husband and I discussed the issue of B.S. having had sex with our daughter,” claimed the mother.

Meanwhile the teenager testified to prosecutors that her brother used his mobile phone to document B.S.’s confession that he had sex with the girl.

A police sergeant testified that police were told about the kidnapping around 6pm.

The judgement remains subject to appeal within 10 days.
