Abu Dhabi: The new rent committees set up in Abu Dhabi will settle disputes between landlords and tenants.

Shaikh Mansour Bin Zayed Al Nahyan, Deputy Prime Minister and Minister of Presidential Affairs and also Chairman of the Abu Dhabi Judiciary Department, issued a resolution establishing the rent committees.

The resolution has mandated the committees to swiftly settle disputes between landlords and tenants, as well as to look into temporary procedures sought by any of the parties in the tenancy contract.

Membership to the committees is for one year and is renewable annually, according to the ordinance.

No members will be allowed to attend or take part in any procedure that would create a potential conflict of interest between them and the parties to the dispute.

The ban also involves members who have relative consanguinity or relationship by marriage up to fourth degree, who act as agents, legal representatives or custodians for either party to the dispute, according to the new ordinance.

Members of the committees will be named by and report to the Judicial Council and will convene at least once a week. Each committee's membership will consist of a minimum of three judges.

Shaikh Mansour issued another ordinance setting up a rent dispute settlement advisory committee and naming Hamad Al Hur Al Suwaidi, member of the Executive Council and Under-secretary of Department of Finance as its chairman, Jabr Mohammad Ganem Al Suwaidi as deputy chairman, Mohammad Omar Abdullah, Abdul Hamed Mohammad Saeed and Jasem Ahmad Hader Al Meraikhi as members.

Other ordinances also set up the cessation committee, to be chaired by counsellor Emam Al Badri, and two appeals committees, to be chaired by judge Moheb Mohammad Hafez and judge Abul Lateef Al Tejani

Eight committees of first instance were also set up, to be headquartered in Abu Dhabi and chaired by judges Abdul Hafez Zeidan, Mohammad Tawfiq Abdul Gani, Ahmas Anwar Al Shishtawi, Jamal Ebrahim Elewa, Mohammad Abdul Fattah Al Shanwani, Abdul Hamed Bin Sulaiman, Ahmad Al Samman Ali and Mohammad Ashraf Al Bulaki.

Another committee to settle disputes has been set up in Al Ain under the chairmanship of Judge Mubarak Al Awad.

Rulings explained

Rulings by the rent committee on leases of up to Dh100,000 are final. Rulings on leases above Dh100,000 can be appealed within 15 days from the date of the ruling and cases related to leases worth more than Dh500,000 may be looked into by the cassation committee. Tenants have 30 days from the date of the ruling of the appeals committee to file with the cassation committee.
