Three charged with molestation, not rape of girl

"The suspects have been charged with sexually molesting the girl and referred to the Dubai Court of First Instance," Dubai Attorney General Essam Eisa Al Humaidan said in a media statement on Sunday.

Dubai: Investigations have revealed that three suspects did not rape a four-year-old Indian schoolgirl but they molested her, said Dubai Attorney General yesterday.

"The suspects breached the modesty of the schoolgirl and molested her after they groped her private parts. There was no rape. Based on the investigations which were conducted by Chief Prosecutor Sami Al Shamsi, Head of Bur Dubai Prosecution, and prosecutor Ahmad Al Attar and Dubai Police's forensic reports, the girl was not raped but she was molested.

"The suspects have been charged with sexually molesting the girl and referred to the Dubai Court of First Instance," Dubai Attorney General Essam Eisa Al Humaidan said in a media statement on Sunday.

Al Attar told Gulf News last week that the investigations were about to conclude and a decision to refer the case to court would be taken soon. He also denied that the case was dismissed and that the charges were dropped.

A source said that a hearing would be scheduled soon.

Dubai Police referred the three Indian suspects, who sexually [assaulted] the girl on the bus while driving her back home from school, to the Public Prosecution last month.

The suspects — the bus driver, the supervisor and his assistant — sexually assaulted the girl while she was asleep on her way back home, Al Humaidan said.

Prosecutors requested the court to implement articles 44, 121 and 356 of the Federal Penal Law.

Article 356 stipulates that a suspect who has consensual sex with another partner faces minimum one year in jail.

If the same crime is committed forcefully or against a male or female under the age of 14, a temporary imprisonment of 3-15 years will be handed out to the defendant.

    Handling a small girls privates ... Groping and molesting is just as serious as the rape itself. They should be punished more severely.

    What happans to three men . Earlier they were blamed and charged for raping now says molesting. What are exercise gone to conclude on this. Was the doctor in india went wrong? As per GPS this big bus not parked in a car park so driver was driving ? if driver drives then teh last drop off time diffrence is seems few minitus.

    This is really vague. I pity the girl and her parents who went through all this including the mental disturbance that has caused. There should be no easy penalty.

    Molestation charges still leave a question unanswered, who raped the child? Semen was found on her dress, whose is it? Indian doctor confirmed penetration prior to case being reported. The community wants to stone 3 men, neglecting the evidence present.

    Its very vague....and sad enough, looks like the criminals would get hardly any punishment that they rightly deserve. Are'nt they animals who would exploit further, if left free after a few years. I wish the little girl would be blessed to have a normal state of mind and a good life ahead.

    I believe there are some lapses here; i believe Art. 356 applicable only when the victim is of age. In this case the victim is an innocent child, there must be stiffer law; with all due respect, even if there was no penetration as this is one most important element in rape case, touching of private parts to an innocent child i wish to be be considered. Furthermore, the trauma that caused this incident is irreparable and thus; the child deserve nothing more but mercy in the form of stiff penalty to the accused. But thanks, wheel of justice keep on moving fast.

    This is one of the most strange and unclear news that I have been following over the past few weeks. Firstly, the parents wait for weeks to report the incident to the school authorities and police, which I belive, as a father of two, should have been reported within days. Secondly, what happened to all the evidence the mother presented on the child's clothes? Who was reponsible for that? I strongly believe that there is more to this case and even doubt involvement of the three suspects that the world concluded to be crinimals. Maybe someone else is involved? You are not guilty unless proven.
