Dubai: A staged vomiting saved a woman from being raped but did not keep a taxi driver from going to jail to spend three years behind bars for attempted rape.

The 26-year-old Kyrgyz woman pretended to be sick and about to vomit when the 26-year-old Bangladeshi taxi driver jumped into her seat and tried to rape her.

The woman, O.S., pretended she was feeling nauseous before the driver, D.B., unlocked the taxi door and asked her to get out and vomit.

The Dubai Court of First Instance sentenced D.B. to three years in jail for taking advantage of O.S.’s drunken state and attempting to rape her in the back seat of his taxi.

Prosecutors said D.B. picked up the woman and instead of driving her to her sister’s place, he took advantage of the fact that she was drunk and drove to the beachside. He stopped in an open area that was poorly lit and deserted. Then he used the central locking system and jumped into the back seat intending to rape O.S.

Prosecution records said the Kyrgyz woman foiled D.B.’s attempt to rape her. When he became violent and persisted, she coughed hard and pretended that she wanted to vomit. The driver was said to have quickly jumped back in his seat q and unlocked the doors for O.S. to vomit outside.

According to yesterday’s judgement, the accused will be deported after serving his punishment.

O.S. testified that she stopped the cab at around 3am and asked D.B. to drive her to Abu Hail.

“He took a different route and I suspected that he had bad intentions. So I removed the taxi tag that was pasted on the rear glass without his noticing. I kept the tag inside my purse for future reference in case anything bad happened. I felt scared when he drove towards the beach and slowed down… I asked him why he had stopped when he did so. Then I told him that I wanted to call the police. He didn’t listen to me and jumped into the back seat. He tried to rape me and groped my breasts. I resisted strongly and I defended myself for nearly three minutes but when I felt that he was about to overpower me… I made a noise and pretended that I wanted to vomit,” she claimed.

Police arrested the defendant shortly after they identified him from the tag that O.S. had removed from the glass.

Tuesday’s judgement remains subject to appeal within 15 days.
