Dubai: A couple were recently jailed for one month each for having consensual sex in a car despite their claims that they ended up in the situation because they had no place to stay.

The Dubai Misdemeanour Court convicted Bangladeshi nationals, J.A, 32, and M.S, 21, of having consensual sex although they insisted that they were married. Both the accused admitted to having sex in a car but contended before the judge that they had gone to an imam at a mosque and solemnised an out-of-court marriage.

J.A. was ordered to spend two extra months in jail on the charge of working illegally for another sponsor and overstaying in the country without paying fines imposed by the Naturalisation and Residency Department.

Prosecution records said the woman’s boss realised that she was pregnant and reported her to the police. M.S. was employed as a hairdresser.

The owner of the salon testified that she reported M.S. to the police after she admitted to having sex with J.A. in his car in Al Mamzar Park. M.S. confessed after her arrest that J.A. had taken her to an imam and that they had been married at a mosque in Al Qusais.

“I am not guilty. We got married and had consensual sex in the back seat of my husband’s car in the park. When my pregnancy became obvious, my boss reported [me to] the police. I slept with J.A. but after he became my husband,” M.S. said.

“The imam did not provide us with any document or marriage certificate but he pronounced us as husband and wife,” the woman claimed.

J.A. said he had met M.S. at Abu Hail Shopping Centre. “We went to the imam and married. We had sex in my car because we did not have a proper house,” he told prosecutors.

The judge ordered that the accused be deported after serving their jail terms.
