Dubai: A policeman has denied tricking a college student into joining him for a drive and allegedly raping her in an unlit and unpopulated spot in Muhaisna.

Prosecutors charged the 21-year-old Emirati policeman with kidnap under threat of the 20-year-old compatriot woman and raping and sexually molesting her. They asked the Dubai Court of First Instance to punish him with a death sentence.

"I am not guilty. I did not kidnap or rape her … it was not against her will," argued the policeman, F.A., when he defended himself before Presiding Judge Al Saeed Mohammad Barghout yesterday.

Prosecution records said F.A. threatened to kill the woman, M.J., if she did not drive her car behind him. Under duress and in fear of being killed, she drove behind him until they stopped in front of the mounted-policemen station in Al Qusais where she parked her car and drove with him, according to the charges sheet.

The defendant strongly rejected the charges, pleaded innocent and claimed that the woman agreed to have sex with him.

Compensation

The woman's claimant in civil right, advocate Eisa Bin Haidar, told Presiding Judge Barghout that his client is seeking Dh20,000 in temporary compensation.

M.J. testified that she exchanged contact details with the suspect when he approached her in Abu Hail, claiming that they used to play together at her family's house during childhood.

Records showed the woman used to answer his calls on a random basis.

"The incident happened one evening when I went out with my friend to buy dinner. He called and threatened to kill me if I didn't follow him. I rang up my friend K.K. and gave her the suspect's car details … I asked her to inform the police in case I didn't phone her within 5 minutes.

"I rode with him after I parked my car … he drove off and pulled over in an unlit and unpopulated area where he raped me. He claimed that [he] took pills [without specifying their type] and threatened to commit suicide after killing me. While raping me, a person knocked at his window … the suspect dismissed him and drove off," she alleged.

She claimed that he pulled over in another spot and while molesting her, she managed to dial 999 to let the police hear what was happening.

An Emirati first corporal, who questioned F.A., said the suspect claimed to him that the girl was his friend and she had asked him out.

"He claimed that she called him and asked him to take her out because she was bored … after she insisted, they went out and had sex in his car," he said.

Medical reports confirmed that the woman had no injuries and that sex had taken place. The trial continues.
