Man acquitted of forcing roommate to have sex with him
A worker has been acquitted of charges of forcing his roommate to have sex with him due to lack of evidence, a court has ruled.
Dubai: A worker has been acquitted of charges of forcing his roommate to have sex with him due to lack of evidence, a court has ruled.
Records said the Pakistani victim, K.M., vanished from the country after reporting the alleged abuse to the police.
The Dubai Court of First Instance cleared the 29-year-old Pakistani suspect, T.A., because the victim did not show up before the judge to corroborate his accusations.
The suspect spent more than six months in detention until his innocence was pronounced recently.
Innocent
"This is probably the first case of its kind in which the Public Prosecution charged a suspect of having forcible sex against the victim's will without hearing the latter or questioning him. The victim returned to Pakistan without testifying in court or before the public prosecutor... and still the Public Prosecution referred our client (T.A.) to court," argued defence lawyer Nasser Hashim of Al Kamali Advocates and Legal Consultants
"T.A. is innocent. This is not even a lawsuit and it shouldn't have been referred to court on groundless allegations. The victim's claims are fabricated and false," added Hashim.
The Public Prosecution charged T.A. with beating the victim and having sex with him. His 29-year-old compatriot, O.R., was charged with aiding and abetting a crime.
The duo denied the charges when they appeared before the court which acquitted O.R. due to lack of evidence.
The initial verdict is still subject to appeal.
