Court hears friend invited him to stay the night at her flat because he was depressed

Dubai: A man has been accused of raping his friend in her bedroom on Christmas Eve after she invited him to sleep over because he was depressed about being unemployed.

The 29-year-old Kyrgyz man, A.K., told the 25-year-old Russian woman that he needed a friend to talk to in December 2013.

Although the woman’s bedroom had separate beds, the defendant is alleged to have sat on the woman’s bed, pinned her down and raped her.

Wardens did not bring the suspect, who is being held in detention, before the Dubai Court of First Instance where he was scheduled to enter a plea on Wednesday.

The woman told prosecutors that her friend had said he wanted to discuss his concerns about not having a job with her.

“I called him and we met in front of my building where we chatted for a while. He was complaining to me about his bad luck and how he had been suffering with not finding a job since he came to Dubai in October. He also alleged to me that he did not have a place to stay. Considering that my roommate was away for the night, I invited him to spend the night at my place. We watched television and went to sleep at 2.30am. Although the two beds in the bedroom are separate he sat beside me. He pushed me back and pinned me down to the bed … he raped me after he stifled me. I cried and begged him to leave me, but he didn’t stop.”

She said when he stopped she asked if she could go to the washroom and then fled.

“I stayed at a friend’s place until the next day. Friends advised me to report the matter to the police … I hesitated because I thought that I might land in trouble because I had willingly invited him to stay at my place,” she told prosecutors.

Records said police arrested the defendant a few days after the woman filed a rape complaint.

A police lieutenant testified the suspect denied having sex with the women and that he had just touched her.

Meanwhile a police major testified to prosecutors the suspect said that he had consensual sex with the woman but denied rape.

“When I informed the director of the police station, he decided that it was a case of consensual sex. The man and the Russian woman were referred to the Public Prosecution,” the major told prosecutors.

Prosecutors decided the woman had been raped.
