Dubai: A businessman has lost his legal battle against his ex-wife and will be jailed for five years for attempting to murder her by throwing her from the second floor balcony of his hotel apartment.

The 38-year-old Tajik businessman was said to have tried to kill his 19-year-old countrywoman wife by throwing her from the balcony in Al Rifaa in April, 2012, while drunk.

The 19-year-old, F.Z. accused her former husband of attempting to kill her when he overheard that she slept with men for money. The Dubai Cassation Court rejected the defendant, J.S.’s, appeal and upheld a five-year prison term against him. He will be deported following the completion of his sentence.

Court records said J.S. was under the influence of liquor when he tossed F.Z. from the balcony.

He was also fined Dh2,000 for drinking alcohol.

When he appeared in court, J.S. pleaded not guilty.

“I was drunk at the time when the incident happened… she is the one who threw herself from the balcony. I did not do it.”

The legal battle between the businessman and his ex-wife will now move to the Dubai Civil Court.

The court has ordered J.S. to pay Dh21,000 in temporary compensation to F.Z.

Swift medical intervention helped save the life of F.Z., who was taken to hospital after her fall.

The accused claimed he left the scene because he did not want to be arrested by police as he was wanted over cheque cases.

F.Z. said her husband became outraged and attacked her after he put his friend on speakerphone to say that she had slept with strangers for money.

F.Z.’s father testified that the defendant’s friend told him over the phone that his daughter had been admitted to hospital.

An Emirati policeman testified that J.S. admitted that he beat F.Z. but did not throw her off the balcony.

“He claimed that his wife worked in prostitution under her parents’ supervision. J.S. claimed that F.Z. jumped from the balcony when he confronted her,” said the policeman.

The ruling is irrevocable.
