NOC eligibilty

I would like to refer my friend's case regarding his termination from his current employer due to downsizing. His contract is limited. Is he entitled to get NOC from his employer since the latter refused him stating that it is company's policy? There's a new job waiting for him but he cannot process his transfer due to his current employer's stubbornness regarding NOC.

I would like to clarify to the questioner that if his friend has not completed three consecutive years with the employer, the Labour Law requires that he should obtain the No Objection Certificate to transfer the sponsorship.
