Questioner from Dubai asks: I have been working in a company for more than 3 years; my problem is that my company does not appreciate the efforts of workers. One month ago my company filed absconder complaint falsely against one of the workers so as to evade his end of service payment. I’m expecting my company will file absconder complaint against me at any moment.  My question here is 1. What are the penalties of the Ministry of Labour on such companies if proved that the absconder complaint is false? 2. Can the sponsor file absconder complaint against the worker while he is not in the country? Please advise me, thanks. 

I would like to clarify to the questioner that if it is proved to the Ministry of Labour that the absconder complaint made by the sponsor is false, such complaint will be deemed to be forgery in an official document, as the ministry may transfer the person who filed the false complaint to the Public Prosecution for the hoax and forgery of official document. Finally the employer can’t file absconder complaint against the worker while he is not in the country as per the labour office rules.
