LANDMARK DECISION: In a landmark decision, a UAE court has taken a significant step towards decriminalising debt-related issues. The ruling by the Dubai Court of Cassation eliminates the risk of debtors, whether individuals or businesses, being arrested for failing to meet their payment obligations. This applies to a wide range of debts, including personal loans, business loans, and credit card dues. Individuals who acted as guarantors for loans taken by someone else will not face criminal charges if the debtor defaults. This judgement marks a significant shift, and aligns with the government's ongoing reforms related to bounced cheque offences. Now, jail for debtors will only occur if certain conditions are met, such as proven financial capability (wealth), evidence of fund smuggling or concealment, or the debtor's cessation of debt repayments, provided that the cessation is not due to new circumstances affecting their ability to pay.
