Dubai: A 38-year-old Emirati man on Thursday denied allegations he sexually abused a compatriot inside a prison cell where they are both detained.

"I am not guilty. That incident never happened… and prosecutors did not hold a thorough investigation," contended S.S. when he appeared before the Dubai Court of First Instance.

Prosecutors accused S.S. of having sex with his 24-year-old cellmate, F.A., who was sedated when the alleged crime took place.

They claimed that the accused took advantage of the victim who was reportedly in deep sleep after he took a sedative.

The victim allegedly discovered that he was raped the next day after he went to the wash room and felt the lubricant, which the accused allegedly used on him.

Prosecutors also presented two witnesses — identified as H.A. and H.Y. — who allegedly told the victim that they saw how he was violated.

"I asked S.S. to hand me my sedative medicine… and then I fell asleep while chatting with him. The next day I discovered that there was cream in my legs… later the witnesses alleged to me that they saw S.S. having sex with me while I was asleep," said F.A.

H.A. told prosecutors that he and H.Y. saw how the accused undressed the victim and have sex with him.

"H.Y. immediately pushed the suspect away from F.A. and slapped him… the next day we informed him what happened," H.A. testified.

H.Y. meanwhile, said F.A. was enraged and confronted the accused after they told him what happened.

Groundless

The accused meanwhile asked the court to summon the victim as well as the witnesses and allow him to disprove their allegations.

"Your honour, I ask the court to summon the cellmate and two prosecution witnesses to hear their statements… this is a fabricated and groundless case. The cellmate and the prosecution witnesses were on dispute," the defendant argued before Presiding Judge Hamad Abdul Latif Abdul Jawad at courtroom four.

One year in jail for rape

Meanwhile, three Bangladeshi men were sentenced to one year imprisonment after the Dubai Court of First Instance found them guilty of raping a compatriot in a worker's accommodation in Al Ghusais in Dubai.

Presiding Judge Hamad Abdul Latif Abdul Jawad ruled that the three will be deported after serving their sentence. The verdict is subject to appeal within 15 days.


Prosecutors also charged the trio, 36-year-old M.A., 23-year-old A.M. and 25-year-old A.H., of endangering the life of their compatriot by inducing him to get intoxicated and later forcing him to have sex. The trio pleaded not guilty and claimed they had consensual sex with the victim.
