Actress Halle Berry cannot take her daughter Nahla with her to France, a court has ruled.

Berry, who is now engaged to French actor Olivier Martinez, had Nahla, 4, with former partner Gabriel Aubry.

Canadian model Aubry, who lives and works here, had petitioned the court to stop Berry’s plans as it would give him limited access to his daughter. The duo appeared in court here Friday, reports tmz.com.

The 46-year-old actress argued the privacy laws were stronger in France and would keep Nahla safe from the paparazzi. But the court reportedly judged in favour of Aubry.

For now, Berry and Martinez have put their wedding plans on hold, while the actress is focused on her custody battle, but she revealed they hoped to have a child together soon.

Berry and Aubry split in 2010, and she met Martinez the same year on the set of “Dark Tide”.

She was married to former baseball player David Justice from 1993 to 1997, and later to singer Eric Benet from 2001 to 2005.
