Dubai: A salesman was cleared of hurling a naked woman from his hotel window down to the street but both were jailed for three months each for having consensual sex.

The Dubai Court of First Instance acquitted the 37-year-old Briton, Z.A., of hurling the 36-year-old Ukrainian woman, A.K., from the first floor and causing her 30 per cent permanent disability.

Pronouncing Thursday’s judgement, Presiding Judge Hamad Abdul Latif Abdul Jawad jailed Z.A. and A.K. to three months each for having consensual sex. The Briton was additionally fined Dh1,000 for consuming liquor.

“The two accused will be deported following the completion of their jail terms,” said the judge in courtroom three.

Z.A.’s acquittal of assaulting and injuring A.K. came after his lawyer Ali Abdullah Al Shamsi argued that his client did not throw the girl from the window.

“She went inside the kitchen on her own and locked the door from inside. She jumped by herself and my client did not hurl her from the window like she claimed… this has also been confirmed by witnesses. A witness testified in court earlier that the kitchen door cannot be locked from outside, but only from inside… hence this counters the woman’s claims,” contended advocate Al Shamsi.

Meanwhile, the court rejected A.K.’s civil lawsuit in which she sought Dh20,000 in temporary compensation against her alleged damages. The Ukrainian was taken from court into custody immediately after the hearing.

A prosecution witness claimed that A.K. informed him that she threw herself from the hotel room’s window to escape from the Briton.

When asked by advocate Al Shamsi on whether A.K. jumped on her own or that she was thrown, the witness replied: “A.K. told me that she jumped on her own and that she was not thrown. She said she jumped off the window because she was afraid of Z.A. wanting to kill her.”

Prosecutors charged Z.A. with getting drunk and causing permanent disability to A.K., who records described as a sex worker, after throwing her from the window.

Z.A. and A.K. were charged with having consensual sex.

An Indian receptionist testified that seconds after A.K. landed on the top of a car in front of the hotel, she walked naked into the reception crying for help.

“She was petrified and hurt… she was completely naked and asked me to call the rescue teams. She said a crazy man threw her from the window of Room 105,” the receptionist told prosecutors.

An Emirati policeman testified that Z.A. pushed A.K. out the window after she not only refused to continue having sex with him but proceeded to quarrel with him over her fees.

“No I didn’t have sex with her. I consumed alcohol,” Z.A. said in court.

A.K. pleaded not guilty.

The primary judgement remains subject to appeal within 15 days.
