Dubai: A driver has been handed three years in jail for luring a waitress to a first-floor flat and trying to rape her before she leapt from the window and injured herself.

The 28-year-old Pakistani defendant, I.H., lured the 21-year-old Filipina waitress to the flat claiming that he wanted to get to some papers from his office.

Then he removed his clothes and undressed the woman and attempted to rape her after he locked the door from inside.

The Filipina sweet-talked the defendant into getting her water to drink. Once I.H. went to the kitchen to get the water, the half-dressed Filipina jumped from the window in November.

She was rushed to hospital after she fractured her hips when she landed on the pavement and lost consciousness.

The Dubai Court of First Instance convicted the accused of using physical violence and attempting to have sex with the Filipina against her will.

“I did not try to rape her. She rode with me in my car and agreed to accompany me to the flat to have consensual sex. After I undressed both of us, she suddenly decided to stop. Then she ran to the window and jumped,” said the accused when he entered an innocent plea.

Presiding judge Fahd Al Shamsi said the defendant will be deported following the completion of his punishment.

Prosecutors said the Pakistani picked up the waitress from the street. He stopped in Freij Al Murar and claimed that he wanted to retrieve some work papers from his office. She willingly went up with him to the flat.

The defendant locked the door and attempted to rape the Filipina, who broke free and jumped from the window.

The woman said the incident happened after she accompanied the defendant in his car to Global Village at 5.30pm.

When the woman regained consciousness following the jump, according to her statement, she realised that the accused had kept her purse beside her at the pavement and left.

Medical reports confirmed that the Filipina sustained fractures in her hips and bruises to her knee.

A Pakistani shopkeeper said he called up the police once the woman landed in front of his shop on the pavement.

A police lieutenant said I.H. turned himself in and claimed that he had agreed to have consensual sex with the waitress.

Wednesday’s ruling remains subject to appeal within 15 days.
