Dubai: The Dubai Court of First Instance handed an Emirati man a six-month suspended imprisonment sentence for kidnapping a Filipina and threatening to have her gang-raped by his friends and also threatening to kill her.

Presiding Judge Al Saeed Mohammad Barghout convicted the 26-year-old man, M.K., of forcing the 31-year-old Filipina into his vehicle and threatening to take her to Mirdif where, according to his threat, his friends would rape and kill her.

The defendant pleaded not guilty. The six-month imprisonment will be suspended for a period of three years during which time the crime must not be repeated.

Along with M.K. prosecutors had charged his uncle who is at large. According to the charge sheet, the defendant was accused to have used force to kidnap the Filipina and verbally threaten her by saying: "I will take you to Mirdif where all my friends will have sex with you and then I will kill you."

The Filipina testified that the defendant and his uncle kidnapped her from in front of her house in Satwa while she was waiting for her friend at around 4am.

"My friend asked me over the phone to wait for her because she needed me to walk her to the grocery… suddenly the suspect and his uncle [identified in the records as W.D.] drove up to me and asked why I was standing there.

"I refused their offer of a lift after telling them that I was waiting for my friend. I walked away but they followed me in their car before the suspect got out and pulled me by my hair and beat me hard. He slapped me repeatedly. I tried to escape from his grip and run to the bus station, but he continued beating me. Then he pulled me down to the ground and put his foot over my head… then he bit my right ear," the Filipina told the prosecutors.

The judgment remains subject to appeal within 15 days.
