I stood as guarantor for friend

A reader in Dubai asks:
I have a friend who is involved in a case in which three people were held. The court released them on bail and I stood as a guarantor for my friend by submitting my passport. But now he has disappeared and there is no news about him. What if he does not appear in court on the day of the hearing? What is the risk of being a guarantor in this case?

As per Articles 111, 112, 113 and 114 of Criminal Procedures UAE Code No. 35 (1992) and its amended version no. 29 (2005) the guarantor is legally responsible for the absence of the accused in any case. Therefore, the court will direct you to pay a certain fine before releasing your passport, as soon as the case is over.
