Dubai: A jobless man will be jailed for two years after losing his appeal in the case of kidnapping a college student, taking him to the desert, filming him nude and trying to rape him.

The 25-year-old Emirati defendant and four of his friends met the 19-year-old Emirati student outside a billiard centre in April 2017.

The accused invited the student to join him for a car ride, and drove off with him and his friends to a remote area in the desert.

The 25-year-old and his friends ganged up against the student, beat him up and pinned him down to the ground. The 25-year-old then tried to force himself on the student after he refused to allow them to have consensual sex with him.

The accused also filmed the 19-year-old partly nude before the latter fought with them and foiled their bid to rape him.

In December, the Dubai Court of First Instance jailed the 25-year-old for two years for kidnapping the victim, beating and molesting him and trying to rape him. He was also convicted of stealing the student’s car, phone and wallet.

The defendant’s four accomplice remain at large.

The accused appealed his primary ruling before the Appeal Court and sought to be acquitted.

Presiding judge Saeed Salem Bin Sarm rejected the defendant’s appeal and upheld his two-year jail term.

According to the appellate ruling, presiding judge Bin Sarm said the mobile phone that was used to film the victim will be confiscated.

The Emirati defendant pleaded not guilty in court.

Records said the defendant and four runaways lured the student into the car. They beat him repeatedly and when he refused to allow them to have sex with him, they removed his clothes. They also breached his modesty when they filmed him naked and tried to rape him. They also stole his wallet that contained Dh250 and his college ID besides his car key and phone.

In court, the 25-year-old strongly dismissed all the accusations.

The 19-year-old testified that the incident happened as he was entering a billiard centre in Abu Hail area.

“The defendant and his friends offered me a car ride and I joined them. They drove off to a desert area where they grouped up against me … they beat me and asked to have sex with them, but I refused. They removed my shorts. I foiled their bid to rape me,” he said.

The student’s father testified that he reported the matter to the police when his son told him about it.

Records said the student’s car was found parked in Ajman.

The appellate ruling remains subject to appeal before the Cassation Court.
