Questioner from Dubai asks: my daughter is accused of a criminal case for giving a cheque with big amount and she is presently subject to trial before Dubai Criminal Court, whereby she might be sentenced to imprisonment. My question here is whether it is possible for the court to imprison my daughter despite the fact that she has got a baby one month of age and nobody can take care of him in case she go to jail. So, in case of imprisonment, what will happen to the baby and who will take care of him please advise.
I would like to clarify to the questioner that when the Criminal Court imposes the sentence of imprisonment on the accused, the questioner’s daughter, the court will not consider the issue of custody, and if the court found that the accused is guilty, the latter will carry prison sentence even if the court found that the accused has got a baby one month of age. Therefore, in case of imprisonment, the accused may request for the child aged one month to join her in the prison; such request might be approved.
