Tour operator and driver held liable for safari accident
A German national who lost his wife in an accident during a desert safari trip has won Dh300,000 in temporary compensation after a court held a tour operator and the driver provided by the company responsible for the accident.
Dubai: A German national who lost his wife in an accident during a desert safari trip has won Dh300,000 in temporary compensation after a court held a tour operator and the driver provided by the company responsible for the accident.
The Dubai Civil Court ordered the Dubai-based tour operator, the Arab driver and the company that insured the wrecked vehicle, to jointly compensate the plaintiff Dh200,000 in blood money and an additional Dh100,000 towards the emotional and moral distress he underwent.
The German national had, in his civil lawsuit, demanded Dh1.5 million in compensation from the defendants following the accident, which left him and his two daughters with injuries. The Arab driver, T.M., had earlier been presented before the traffic court in Oman and jailed following the accident in the Shaja area of Oman.
According to UAE laws, the plaintiff has the right to sue the tour operator, the driver and the insurance company in the jurisdiction of Dubai, where they are all based.
The man claimed in his lawsuit that the car swerved off the road and dashed into a rock after the driver lost control.
Omani authorities detained the driver and referred him to court where he was charged with speeding and reckless driving and causing the accident that led to the woman's death and injuries to other members of the family. He was sentenced and jailed in Oman.
