Three to be prosecuted for deaths of D'Souza children

Doctor, cook and supervisor charged with negligence that led to poisoning of children

Dubai: A doctor, a cook and a restaurant supervisor are being prosecuted for negligence which allegedly led to the deaths of two children from food poisoning.

Prosecutors charged the 46-year-old Iraqi woman doctor, 25-year-old Nepalese cook and 33-year-old Filipino supervisor with negligence leading to the deaths of a five-year-old boy, Nathan D'Souza, and his seven-year-old sister Chelsea, last year.

The three suspects pleaded not guilty when they appeared before the Dubai Misdemeanours Court.

Gulf News has learnt that the defendants are scheduled to appear in court Monday to submit their defence or ask for an adjournment to hear prosecution witnesses.

The Iraqi doctor's lawyer Mohammad Al Suwaidi told Gulf News Sunday: "My client has pleaded innocent since the beginning of the investigation … she denied any negligence. The forensic doctor testified during the prosecution's questioning that my client did not commit any malpractice. We might submit our defence in today's hearing."

Senior prosecution sources told Gulf News that the cook and the supervisor have been charged with violating the public health requirements of Dubai Municipality through unhygienic practices in preserving the food, which led to bacterial contamination.

The doctor was charged with negligence in providing medical care to the children when they were admitted to hospital after eating a meal from the restaurant.

According to the chargesheet, prosecutors said the children did not receive the necessary medical care to treat the food poisoning. The restaurant has also been added to the list of suspects.

In October, the Dubai Public Prosecution had assigned the higher committee for medical liability in Abu Dhabi to look into the case.

    All this shows the lack of Care and attention shown to wards patients. If doctors start being negligent who do we rely on? how can we trust hospitals? I am amazed that this takes a lot of time to investigate. i am anxiouisly waiting for a positive out come . As it is In dubai i have noticed that in some hospitals doctors dont know their job and they dont know how to treat a patient with care. its either too much of attitude and a lot of discrimination that i find which we need to put a full stop to. i have also heard a lot of cases where patients have been just ignored and asked to visit other hospitals due to lack of beds available. the service is just pathetic in some hospitals and its high time for the mgt to intervene before it leads to severe reparcussions. Take your jobs seriously and care for patients.

    Hats off to Gulf News for bringing back this issue... I was very recently thinking that press over here does not report back incidents which affects general public but I am happy to be proven wrong. Hopefully, justice will prevail and D'souza's will get some sort of consolation with right kind of justice although its true the loss they have suffered can not be even felt remotely by others. I wish the Almighty to give them strength to overcome this situation. Thanks

    "Oil and truth will always come to the surface", justice rendered to the beraved family and to the little kids who left for their heavenly abode pre-maturedly and untimely. Valueable lessons must be learnt from the past and concerned institutions should gear up & list out penalties for negligence, so that an awareness is created amongst the hotel industry. On an average 80% of the Dubai's population is dinning out daily or at least thrice a week, hence sufficient precautions should be in place to avoid such incidences in future.

    well it is very heart rending,,,no words can comfort the loss these children,,,May god bless the parents and may they recover from this pain.... Yes the punishment has to be severe so no mistakes fromanyone else will take place..... and no such losses ..... god be with these parents...

    People do forget there is almighty up there watching our actions.....honestly even me i forgot these issue but when i read it today i am happy that justice will be done to D"souzas for the loss they gone through its very tough...may the duo get the sweetest place in heaven.
