Seeking justice when wronged

Any resident in the Emirates can approach the courts if their rights are violated as the laws are designed to protect everyone.

Dubai: Any resident in the Emirates can approach the courts if their rights are violated as the laws are designed to protect everyone.

One can file a case at any court in the seven emirates, but it should be in the emirate where he or she was wronged.

Some cases will be transferred from the police to the public prosecutor and then to the court. In some cases it can be filed at the court directly.

If you file a case in any of the country's courts, or if someone files a case against you for any reason the case will go through several stages before the judges issue their final verdict.

Such a process is in place in order to be sure that everyone gets his rights and so that judges have discussed and looked at the case and studied it carefully before giving their final word.

The judiciary system in the country works in a way so that every person who had to enter the court for any reason will have his full rights without any prejudice.

Three stages

A case will go through three stages; the first will be through the Court of First Instance which is the first phase in the trial procedure. Here one can claim his or her rights or approach that court to make use of its services.

The Court of First Instance accepts civil, criminal and Sharia cases. The second stage at the country's courts in the trial process is the Court of Appeal in which the person who filed the case or if he or she is the accused in a case can appeal the decision of the Court of First Instance.

The court at this stage could either revise the appealed verdict or cancel it, even if the cases are related to Sharia, civil or criminal cases.

The appeal should be made within less than 15 days of the first sentence issued by the Court of First Instance. Then your case will go to the Court of Cassation, which is the third stage in the trail process.

Cases at the courts in Sharjah, Ajman, Ras Al Khaima, Umm Al Quwain, Fujairah and Khorfakkan will then be transferred to the Abu Dhabi Supreme court, which will issue its sentence.

But the case can be revised again by the Court of Appeal in the emirate which issued the sentence and then the final sentence will be issued by the Abu Dhabi Supreme Court which should be implemented. In some cases the sentence will not be revised twice by the Supreme Court.

In cases, where the accused does not have a lawyer to defend him or her, the Ministry of justice will appoint a lawyer to defend them regardless of their nationalities.
