Dubai: A mechanic has been jailed for six months for having consensual sex with a worker, who claimed that the mechanic had forced sex with him at his residence.

The 34-year-old Pakistani mechanic, Z.A., repeatedly phoned his 21-year-old countryman and invited him to stay at his house, where he had sex with him in May 2014.

Prosecutors said Z.A. lured the worker to his room and had forced sex with him.

The defendant claimed before the Dubai Court of First Instance that he did not rape the claimant, contending that they had consensual sex.

“He agreed to have sex with me and he removed his clothes willingly,” argued the defendant when he said that the worker lied about being raped.

Presiding judge Mohammad Jamal convicted Z.A. of having sex with the claimant.

According to Tuesday’s ruling, the accused will be deported following the completion of his punishment.

The 21-year-old claimed to prosecutors that the mechanic phoned him several times over a period of a few days and insisted on him coming and staying at his place.

“I took off from work and went to visit him. After we had dinner at a restaurant at Jumeirah Lakes Towers, the defendant asked me to accompany him to his residence. He shared a room with five others. We went for a walk and then we returned to the room… he locked the door. When I asked him why he had locked the door, he said that each of his roommates has a key and he wanted to sleep. Suddenly he lifted me and threw me on his bed. I tried to resist him, but he was stronger than me physically. He had forced sex with me… then he took me to the washroom and made me take a shower. He then ordered me to sleep beside him on the same bed because they other beds belonged to his roommates. I left the next day. I called my father and told him what happened. My father said that I should report what happened to the police,” alleged the worker.

Dubai Police’s forensic examiner said the claimant’s body did not bear any signs of force.

The primary ruling remains subject to appeal within 15 days.
