Bollywood superstar, Salman Khan, has been booked for several counts under various sections of the Indian Penal Code, The Motor Vehicles Act and the Bombay Prohibition Act. Learn what these sections are and why he has been convicted under them.

 

1. Section 304 (ii) or in lay terms culpable homicide not amounting to murder.

What the Law says For an automobile accident that results in the death of a person due to the rash and negligent act of the driver, the conviction can be maintained for the offence under Section 304 Part II IPC even if such an act was done with the knowledge that by such act, death was likely to be caused. 

Why he's convicted Salman was booked under this for knowingly drinking and driving which resulted in the loss of one man’s life and the injury of four others, apart from the destruction of public and private property.

 

2. Section 279 includes rash driving or riding on a public way.

What the law says Whoever drives any vehicle, or rides, on any public way in a manner so rash or negligent as to endanger human life, or to be likely to cause hurt or injury to any other person, shall be punished with im­prisonment.

3. Section 337 includes causing hurt by act endangering life or personal safety of others.

What the law says Whoever causes hurt to any person by doing any act so rashly or negligently as to endanger human life, or the personal safety of others, shall be punished with imprisonment.

Why he's convicted The result of Khan's drink-driving was that he ended up running over and killing a man on the pavement beside the road.

 

4. Section 338 includes causing grievous hurt by act endangering life or personal safety of others.

What the law says Whoever causes grievous hurt to any person by doing any act so rashly or negligently as to endanger human life, or the personal safety of others, shall be punished with impris­onment.

5. Section 427 includes mischief causing damage.

What the law says Whoever commits mischief and thereby causes loss or damage shall be punished with impris­onment.

Why he's convicted Khan was found gulity of being responsible for the death of one man, injuring four others and causing damage to public and private property.

 

6. Section 134 (Motor Vehicles Act, 1988)

What the law says It is the duty of a driver in case of an accident that has caused injury to a person to secure medical attention for the injured person and report the incident to a police officer or at the nearest police station within 24 hours.

Why he's convicted Khan was found guilty of fleeing the scene of the crime and failing to report the incident to the police at the time it happened.

 

7. Section 185 (Motor Vehicles Act, 1988)

What the law says Driving by a drunken person or by a person under the influence of drugs is prohibited.
